E.g. in 12/06/01 he attempted to negotiate extended repayment terms on the understanding that his debt would be met in full. Refer his letter of 12/06/01 to Ralph Ward. Our legal expenses have been considerable as the attached “account schedule” and “Tax Invoice” of 5/2/01 demonstrate. On at least one occasion when payments have been received his cheque has been dishonored. Refer National Bank statement of February 15 showing dishonored cheque fee. Richard O’Neill quoted an incorrect address to the court with a view to preventing visits by bailiffs – refer correspondence of 18/12/2002 between my solicitor Ralph Ward and the Department of Transport. The Sheriff, on visiting his claimed residential address, was told by Mr O’Neill that all assets at the address belonged to his mother. Refer “Notice that Levy Has Not Been Made” of 12/06/01. This statement was at variance with his affidavit of 30/10/10 where he declared assets including furniture ($500) and electrical goods ($2,000). Following a complaint by us, the Department of Transport NSW reviewed his operation, “revealed a number of deficiencies” and cancelled his accreditation number 22261. As of today’s date, he continues to run tours and to unlawfully quote the accreditation number. Refer page 4 of the document “Across Australia…. Country Connections” The Department of Transport has advised me that they have written to him requesting that he desist. Refer Transport NSW letter to RK Ward of 31/1/2003. He displays distinct psychopathic tendencies including delusions of grandeur and believes my pursuit of him to be completely unjustified. In one letter he claims the legal system to be “out dated” and asks that I not use it. Refer to letter of 21/07/01. Continuing negotiations with him suggest that be remains insufficiently solvent to operate a business. My wife and I maintain the right to bankrupt him at any time and would do so were it not for the fact that his lack of assets mean that our chances of repayment of the debt would then be effectively eliminated.22:43 02/13/2003
