UTEP files lengthy appeal countering NCAA sanctions
EL PASO, Texas (AP) - Texas-El Paso has responded to NCAA sanctions
with a 100-page appeal that argues the penalties imposed against
the university were too harsh.
The NCAA announced May 1 that it was putting UTEP on probation
for five years because of a lack of institutional control and
what were characterized as minor but rampant transgressions of
NCAA regulations in the football, men's and women's basketball
and other programs.
The NCAA found UTEP used ineligible players, incorrectly certified
ineligible players and exceeded the permissible number of football
scholarships, among other violations.
"We're basing the appeal on what we've said all along.
We don't believe that the penalties fit the violations,"
said athletic director John Thompson.
Thompson also said the university objects to the NCAA's finding
that UTEP lacked control over its sports programs.
"In our interpretation of rules and understanding of them
would lead to the conclusion that there was institutional control,"
he said. "Of course, that's a matter of opinion."
Once the NCAA receives the appeal, it will have 30 days to
issue a response and UTEP will have 15 days to file a rebuttal.
After that, the school will have the option of arguing its
position before the NCAA Infractions Appeals Committee, which
UTEP is predisposed to do.
"I think we're trying to give the appeals committee an
impression that we're in need of relief," said Mike Gentile,
UTEP's compliance director.
UTEP will also stress that adjustments have been made, including
the hiring of compliance staff, to ensure the same problems don't
occur again.
"It's something that may not have been developed as well
the first time," Gentile said. "But it's something we're
